Terms of Service

Last updated: 9 October 2026

These terms explain how you may use DYNAM's websites, hosted assistants and desktop software. DYNAM Consulting operates the service and is registered in Ireland. In these terms, “DYNAM”, “we” and “us” mean the business that supplies your service. “You” means the customer. If you act for an organisation, it includes that organisation.

1. Your agreement

You accept these terms when you complete a clearly labelled acceptance step. The Privacy Policy explains how we handle personal data. The SMS and Messaging Terms apply when you use those channels. An order or signed service agreement may add terms for your plan. Mandatory rights under applicable law always take priority.

If a signed agreement changes these terms, it must identify the change. A data-processing agreement controls any conflicting terms about the processing it covers.

2. Your account and workspace

Give us accurate account and contact details. Keep them current. You must have authority to accept these terms and grant the access you request. Protect your sign-in methods. Tell us promptly if you suspect unauthorised access. Do not share access in a way that bypasses the workspace's permission controls.

You are responsible for instructions from people you authorise to use your workspace. This does not make you responsible for failures that applicable law assigns to DYNAM. Account access does not automatically grant access to another customer's workspace.

3. What the assistant can do

An assistant can produce content and use available tools to perform tasks. Its abilities depend on your plan, connected services and device permissions. A description of a tool does not grant permission to use it.

You authorise actions through your instructions, enabled permissions and any standing rules you set. These terms do not give the assistant unlimited authority. They do not replace an approval that the product, a provider or applicable law requires.

State important limits clearly. Include recipients, budgets, deadlines and approval requirements where relevant. Check actions that create material financial, legal or operational consequences. An action may be difficult or impossible to reverse after a third party receives it.

4. Connected services and desktop devices

Only connect accounts and devices that you own or are authorised to use. Grant the permissions needed for your tasks. Access may include reading files, sending messages, changing records or running commands when those abilities are enabled.

Desktop access applies to the device you pair and the permissions you grant there. Pairing one device does not authorise every device you own. A permission change cannot reverse an action already completed.

You can request disconnection or revoke access through the relevant provider or available DYNAM controls. Disconnection stops the connection from being used for new tasks once revocation takes effect. It does not delete third-party records, undo completed actions or erase every copy of previously processed data. The Privacy Policy explains data deletion separately.

5. Purchases and other commitments

An assistant may only make a purchase or commitment within the authority you grant. You must have authority to use any account, payment method or information supplied for that task. Charges from a third-party service are separate from DYNAM's fees unless your order states otherwise. The third party's purchase, delivery and refund terms apply to its transaction.

DYNAM does not become the seller of a third-party product merely because the assistant helps you buy it. This does not exclude any responsibility DYNAM has under applicable law.

6. Your content and our software

You keep your rights in the content you provide. You permit us to process that content to deliver your requested service, maintain security and meet legal obligations. This permission is limited by the Privacy Policy and any applicable data-processing agreement. Accepting these terms does not itself grant blanket permission to train AI models on your private content.

You may use generated content, subject to applicable law and third-party rights. We do not guarantee that an output is unique, accurate or eligible for intellectual-property protection.

DYNAM and its licensors retain their rights in the service's software, brands and proprietary materials. These include private source code, internal instructions and non-public workflows. Your access lets you use the service. It does not transfer ownership of those materials. Open-source components remain subject to their own licences. These terms do not remove rights granted by those licences.

7. Confidential material and prohibited use

Do not attempt to access another customer's information or bypass access controls. Do not use the service for fraud, unlawful surveillance, unsolicited messaging or other unlawful activity. Do not interfere with the service or expose credentials that are not yours to disclose.

Do not copy, sell or disclose non-public DYNAM materials that you receive under a duty of confidence. Do not reverse engineer DYNAM's proprietary software except where applicable law permits it despite this restriction. These restrictions do not prevent lawful use of your own content, open-source rights or protected disclosures.

A confidentiality duty does not cover information already public through no breach of that duty. It also excludes information lawfully obtained elsewhere or independently developed. If disclosure is legally required, disclose only what is required and notify us where lawful.

8. Fees, trials and cancellation

Your order must state the price, currency, taxes, included usage and any extra charges. It must also state the billing period, renewal terms and how to cancel. You authorise only the charges explained and accepted in that order. A trial does not itself authorise an undisclosed paid subscription.

You can contact info@dynamconsulting.com about cancellation or billing problems. Cancellation does not remove charges already properly incurred. Refunds and service remedies remain subject to your order and mandatory consumer rights.

9. Consumer rights

If you buy as a consumer, applicable law may give you cancellation, repair, price-reduction or refund rights. These terms do not remove those rights. Where a statutory withdrawal period applies, the pre-purchase information must explain the period and how to use it. Starting a service early does not automatically waive a cancellation right. Any request or acknowledgement needed by law must be collected separately at the relevant step.

Business orders may have different remedies where applicable law allows them. Marking a personal account as “Business” does not by itself remove statutory consumer rights.

10. AI errors and service availability

AI can produce incorrect content or carry out an instruction incorrectly. Review important outputs and actions. Keep suitable backups of important information. Do not use the service as an emergency-response system. An assistant is not a substitute for a qualified professional in regulated matters.

Features can be interrupted by maintenance, network problems or third-party failures. We do not promise uninterrupted availability or a particular task outcome unless a separate agreement does so. We remain responsible for obligations that applicable law does not allow us to exclude.

11. Responsibility and liability

Each party remains responsible for its own obligations under these terms and applicable law. You are responsible for unlawful instructions and access that you grant without authority. DYNAM remains responsible for duties that cannot lawfully be excluded.

No exclusion or limit applies where applicable law prohibits it. This includes fraud, and death or personal injury caused by negligence where the law prohibits exclusion. Statutory consumer remedies remain available.

12. Suspension and ending access

We may restrict access to address misuse, a security risk, a legal obligation or a material breach. The restriction should be proportionate to the reason. Where lawful and practical, we will explain it and give you a chance to resolve the problem. Urgent protective action may be taken first.

Ending access does not undo third-party actions or remove valid payment obligations. Contact us about access to your information or deletion requests. Data that must be retained remains subject to the Privacy Policy.

13. Changes to the service or these terms

We may update the service and these terms. We will explain material changes and their effective date using a suitable notice. Changes do not rewrite completed transactions retrospectively. Where law requires fresh acceptance or consent, a notice alone is not enough. Any applicable right to cancel or receive a remedy remains available.

14. Complaints, law and disputes

Contact info@dynamconsulting.com with the issue and the outcome you seek. We will try to resolve it before either party starts formal proceedings. This does not delay a legal deadline or restrict urgent relief.

Irish law governs these terms, subject to mandatory protections under applicable law. If you are a consumer, this choice does not remove mandatory protections that apply where you live. It does not remove any right to bring a claim in a court that consumer law permits. Business disputes may be brought before the Irish courts, subject to any signed jurisdiction agreement.
